Man jailed for assaulting passerby for trying to prevent sexual abuse
The Suwon district court in Gyeonggi Province sentenced a man to 30 months in jail for assaulting another man who was trying to stop him from sexually abusing a woman on a street in the provincial district.
The identity of the 22-year-old man is to be publicly posted for a period of five years and is subject to receive 80 hours of psychiatric treatment on the prevention of sexual offenses.
The court said while the sexual offense did not actually take place due to the intervention of the passerby, the intentions of the man in question is criminal and requires punishment to the fullest extent of the law.
The incident occurred in November last year as he attacked the 32-yer-old woman on a pedestrian overpass but was interrupted by the 54-year-old man who reported the potential crime to the police and protected the woman from harm.
'왜 방해해'… 성폭행 말리는 행인 폭행
수원지법 형사12부(부장판사 김정운)는 길거리에서 여성을 폭행하려다 이를 말리던 이에게 행패를 부린 혐의(강간상해 등)로 기소된 김모(22)씨에게 징역 2년 6월을 선고했다고 14일 밝혔다.
또 신상정보 공개·고지 5년, 성폭력 치료프로그램 80시간 이수를 명령했다.
재판부는 판결문에서 '성폭행이 미수에 그쳤지만 이는 자발적 중지가 아닌 피해자 저항과 행인의 신고에 따른 것이고 피해자가 정신적 충격으로 사회생활을 하지 못하고 있어 피고인에게 엄중한 처벌이 필요하다'고 밝혔다.
이어 '다만, 전과가 없는 점, 피고인이 범행을 인정하고 반성하는 점 등을 고려했다'고 선고이유를 설명했다.
김씨는 지난해 11월 오전 5시께 수원시 한 육교에서 집에 가던 A(32·여)씨를 주먹으로 때리고 성폭행하려다가 주변을 지나가던 B(54)씨 신고로 미수에 그친 혐의로 기소됐다.
김씨는 B씨가 자신을 말리며 경찰에 신고하자 주먹과 발로 수차례 때려 전치 2주의 부상을 입히기도 했다.
